Terms & conditions

Please read these terms and conditions carefully before ordering any products from our site. These terms and conditions tell you how we make our products available to you, how the contract can be terminated by you and us, and what you should do if something goes wrong. If you do not agree to these terms and conditions, you must not order any products from our site.

Scope of application

These general terms and conditions of sale apply between any individual or legal entity wishing to acquire one or more products on the site [www.shop.EmileHenry.com] and the company "Emile Henry", SAS, whose head office is located at [13 rue Georges de Vichy](https://maps.google.com/?q=24+rue+Georges+de+Vichy&entry=gmail&source=g) in Marcigny (71110), with a capital of €2,635,000.00 and registered with the Mâcon Trade and Companies Register under number 418 285 300.

Prices

The applicable prices are those presented on the merchant site [www.shop.EmileHenry.com](https://shop.emilehenry.com/fr/) for each product. They are similar to the prices generally observed in physical sales outlets. They are indicated inclusive of VAT, the VAT applicable on the day the order is placed prevailing. A change in this rate may be passed on to the products at any time. Furthermore, Emile Henry reserves the right to modify its prices at any time, the applicable prices being those in force at the time of validation of the order. Prices do not include shipping and delivery costs.

Order and validation

The customer must go through several steps before validating the order. They must register on the site, or identify themselves if they have already registered. Then, after having selected the desired items, the customer chooses the delivery method, either at home or in a relay point (see paragraph on delivery methods). The last step is the validation and payment of the order. Validation of the order implies full acceptance of these general terms and conditions of sale, as well as the payment of the product price.

Products and Availability

The products for sale are those presented on the French commercial site [www.EmileHenry.com](http://www.emilehenry.com/). They are accompanied by a precise description and a photo. Emile Henry undertakes to be as faithful as possible to the quality of the photo, however it may differ slightly from reality, particularly in terms of colour.

Only products in stock can be ordered. Nevertheless, errors may occur. If these are to the customer's disadvantage, the customer will be informed as soon as possible.

Delivery

Emile Henry uses the following delivery services for all its shipments in France linked to the merchant site [www.shop.emilehenry.com](https://shop.emilehenry.com/fr/) :

  • DPD France
  • Colissimo
  • GLS France

In Europe, in the countries listed below, the parcels are sent via the carrier GLS only.

All deliveries in Metropolitan France and Corsica are insured. The deliveries in Europe are ensured only in the following countries: Belgium, France, Germany, Hungary, Italy, Luxembourg, Monaco, Portugal, Republic of Ireland, Slovenia and Spain.

Any country not mentioned above is excluded from delivery.

The shipping costs differ according to the country of delivery and the amount of the order :

- In metropolitan France (except in Corsica), if the amount of the order is greater than or equal to 100€, the shipping costs are offered by Emile Henry. If the amount is less than 100€, shipping costs will be a minimum of 5.90€, depending on the carrier chosen, for deliveries in metropolitan France.

- For delivery in Corsica as well as in the European countries listed above, if the amount of the order is greater than or equal to 100€, the shipping costs are offered by Emile Henry. If it is less than 100€, the shipping costs are 19€.

The customer will be able to follow the progress of his parcel from the moment he receives the shipping notice.

In France, deliveries are made within 3 to 5 working days (unless otherwise indicated) from the time the order is placed.

In Europe, in the countries listed above, deliveries are possible within 6 to 10 working days from the placing of the order.

The delivery time depends essentially on the carrier and Emile Henry cannot guarantee the Customer a precise time. Moreover, during holiday periods, summer closures or lockdowns, this time may be extended.

For any order including one or more personalized products and/or products from the Mix & Match range, the delivery time for the complete order may be extended up to 45 working days (Varies according to quantities). The customer will be notified of the shipment of his package once our workshops have completed the engraving and/or production work. He will then be able to follow the progress of the delivery.

For any order including a spare part, the delivery time of the order can be extended up to 45 working days.

The customer is asked to check, as far as possible, the condition of the package and its contents in the presence of the deliveryman. If the product is damaged, the customer must mention any anomaly on the shipping document, refuse the delivery and report it to Emile Henry within 48 hours.

If the product received does not correspond to your expectations, the customer can first report it to us and then return the package. The return shipping costs are charged to the buyer, in accordance with the Hamon law.

If a delay of more than 90 days after placing the order occurs before receiving the package, the customer can cancel the contract with Emile Henry and be refunded without any penalty.

If the product received does not meet the expectations of the customer, thank you to send, within 14 days of receipt of the package, a message through the form here specifying the reason for return (change of mind or retraction, preparation error, defective product). The modalities and the reimbursement of the initial shipping costs are not the same depending on the reason.

Payment

Payment can only be made via Paypal or by credit card (CB, Visa, Mastercard, American Express).

Regarding cards, Emile Henry uses the Mercanet payment platform of BNP Paribas. All data transfers and all data are secured via SSL (Security Socket Layer) encryption. They are not stored at any time on the Emile Henry platform.

Returns and Refunds

The customer has 14 days from the receipt of the order to withdraw (except for personalized products and Mix & Match), or, if your order is for multiple products sent separately, from the delivery of the final product(s) completing your order. You must do so via our withdrawal form here and choose the subject of the request "product return". The return shipping costs are at the buyer's expense. The package must be returned in perfect condition in its original packaging with a copy of the invoice to the following address

As of the reception of the parcel, if the article is in perfect state, the customer is refunded within 14 days and this directly on the card having been used for the payment. The returns in port due or against refunding are not accepted.

Returns for personalised products / Mix & Match range

Warranty / After Sales Service

Emile Henry ceramic products are guaranteed for 10 years, with the exception of the Delight range, which is guaranteed for 5 years for domestic use. Steel, wood or textile accessories are not manufactured in Emile Henry's workshops and benefit from a 2-year guarantee. For the definition of the warranty, please refer to the warranty page on the website [www.emilehenry.com](http://www.emilehenry.com/). Changes to the warranty period are not retroactive.

If the product is defective in use, the customer has the option of calling or visiting an Emile Henry dealer. If the problem is within the warranty period, the package can be returned to the following address with a copy of the invoice. The return postage will be refunded.

After Sales Service

Emile Henry will send the customer an identical product as soon as possible (subject to availability).

Prohibition of off-network sales

Emile Henry products are an integral part of a distribution network and are not intended to leave it. It is therefore forbidden to offer, buy or sell Emile Henry products with the aim of reselling them outside our networks.

Intellectual property

The logos, photos, images, illustrations, comments, recipes and everything presented on our site [www.emilehenry.com](https://emilehenry.com/fr/) are protected in accordance with the intellectual property code. Any partial or total reproduction of the site [www.emilehenry.com](https://emilehenry.com/fr/) is strictly forbidden.

Responsibility

Emile Henry, for all stages of a sale on its commercial site [www.shop.emilehenry.com](https://shop.emilehenry.com/fr/), has only an obligation of means. Emile Henry is not responsible for any changes to the proper functioning of the site caused by the Internet, in particular a break in service, external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with jurisprudence.

Modification of the general conditions of sale

Emile Henry reserves the right to modify these terms and conditions of sale at any time, those applicable being those in force at the time the order is placed.

Protection of personal data

Emile Henry only collects data from customers that is essential for the proper conduct of the sale and delivery. This data is protected by a secure access. Emile Henry undertakes not to transmit them to a third party without the prior authorisation of the customer.

Archiving proof

The computerised records kept by Emile Henry will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Applicable law / Litigation

The present general conditions of sale are subject to French law. In the event of a dispute, and after having tried to find an amicable solution, the French courts will have exclusive jurisdiction.

In accordance with the order of 20/08/2015, any consumer has the right to have recourse free of charge to a consumer mediator for the amicable resolution of a dispute with a professional.
