Please read these terms and conditions carefully before ordering any products from our site. The present terms and conditions of sale set out how we put our products at your disposal, how the contract may be terminated at your initiative and at ours, and what you should do in the event of a problem. If you do not agree to these terms, you should not order products on our site.
The present general terms and conditions of sale apply to all natural or legal persons wishing to purchase one or more products at www. EmileHenry.com (hereinafter referred to as "the client") and "Emile Henry", SAS company whose headquarters is located at 13 Rue Georges de Vichy Marcigny (71110) France, with a capital of €1,444,443, registered with the RCS of Macon under number 531 997 765 00015.
The applicable prices are those shown on the site www.EmileHenry.com for each product. They are similar to the prices generally found at physical points of sale. They are shown including tax (TTC), the prevailing rate being the VAT applicable on the day the order is placed. Modification of this rate may be passed on to the products at any time. In addition, Emile Henry reserves the right to change its prices at any time, the applicable rates being those in effect at the time the order is validated. Prices do not include shipping and delivery costs.
There are several steps for a client to go through before an order is validated. The client must first register on the site, or log in if already registered. Then, having selected the desired items, the client must choose the method of delivery, at home or to a pick-up location (see delivery paragraph for pick-up location options). The last step consists of validating the order and effecting its payment. The order validation implies full acceptance of the present terms and conditions of sale, and requires payment of the due cost of the product.
The products on sale are those shown in the French online shop www.ShopEmileHenry.com. They come with a detailed description and a photo. Emile Henry undertakes to provide photos that are as faithful as possible to the actual items, however it may happen that there is a slight difference, especially as regards colours.
Only products that are currently in stock can be ordered. However, errors may arise. In the event such errors should arise against the client's interests, the client shall be notified as soon as possible.
Emile Henry uses the GLS France service for all shipments related to the online shopwww.EmileHenry.com. Due to the recent events we only deliver to mainland France, Corsica and the following European countries: Benelux, Germany, Italy, Spain, United Kingdom, Monaco and Austria.
Shipping costs differ depending on the country of delivery and the amount of the order:
- In mainland France (excluding Corsica), if the order totals €69 or more, the shipping costs are paid by Emile Henry. If the order totals less than €69, the shipping costs are €6.90 for deliveries in mainland France.
- For delivery in Corsica and in the countries listed above, if the order totals €119 or more, shipping costs are paid by Emile Henry. If the order totals less than €119, the shipping costs are €14.90.
We do not ship to the Canary Islands, the Italian Islands, the Balearic Islands.
The client can track his/her package from the moment he/she receives the dispatch notification.
In France, deliveries are made within a period of 1 to 6 working days from when the order is placed.
The delivery time depends on the carrier and Emile Henry cannot guarantee a specific time frame to the Client. Moreover, during holiday periods, the delivery time is likely to be longer.
For any order that includes one or more customised products, the delivery time of the whole order may be extended to up to 30 working days. The client will receive a dispatch notification once our workshops have finished the engraving work. The client can track the package from then on.
For any order that includes a spare part, you may not add another product to your order since shipping may require up to 45 days.
The client is requested to check the state of the package and its contents in the presence of the deliveryman, if at all possible. Should the product arrive damaged, the client must describe any anomaly on the shipping voucher, refuse the delivery and notify Emile Henry within 24 hours.
If the product received is not the one that was ordered, the client can first notify us and then send the package back to us. We will reimburse the cost of the return shipping and send him/her the correct product as soon as possible.
If more than 30 days go by after the order is made and the package has still not arrived, the client may terminate the contract entered into with Emile Henry, and receive a full refund.
Payment can only be made through Paypal or bank card (CB, Visa, Mastercard, American Express).
For payments by card, Emile Henry uses the Mercanet payment platform of BNP Paribas. All data transfers and data are secured via SSL (Security Socket Layer) encryption. At no time are these data stored on the Emile Henry platform.
The customer has a period of fourteen (14) days from when the order is received to retract. The package must be returned in perfect condition in its original packaging with a copy of the invoice to the following address:

The client shall be reimbursed within a period of thirty (30) days from when the package is received, directly on the card used for payment, without any penalty apart from the initial postage fees. The return postage fees are at your expense. Products returned with freight collect or cash on delivery will be refused.
By virtue of the provisions of article L.121-20-2 of the Consumer Code, the retraction period of fourteen (14) days does not apply to customised products. Such a service, once paid, is not revocable or refundable. See paragraph 3 of the article L.121-20-2 of the Consumer Code: "the right of withdrawal cannot be exercised unless the parties have agreed otherwise, for contracts... 3° For the supply of goods made to the consumer's specifications or distinctly personalised or which, by virtue of their nature, cannot be returned or are liable to deteriorate or expire rapidly."
The customer may only cancel an order for customisation up to 12 hours after the order has been placed. After this period, production will already have begun and it will no longer be possible for Emile Henry to recover the product thus engraved according to the client's wishes.
Emile Henry products have a 10-year warranty, apart from the 1850 range which has a 5-year warranty, always in the context of domestic use. For full details of the warranty, consult the warranty page of the www.emilehenry.com website. Changes in the warranty period of products are not effective retroactively.
Should the product be defective when put to use, the client may call Emile Henry or go to an Emile Henry retailer. If the problem is covered by warranty, the package may be returned to the following address with a copy of the invoice. The cost of the return shipping shall be reimbursed.
Emile Henry will send a new identical product to the customer as soon as possible (subject to availability).
Emile Henry products belong to a distribution network and are not intended to be sold outside of this network. It is therefore prohibited to receive Emile Henry products as gifts or buy or sell our products with the intention of re-selling them outside of our networks.
The logos, photos, images, illustrations, comments, recipes, and everything that is featured on our www.EmileHenry.com site are protected in accordance with the intellectual property code. Any partial or total reproduction of the www.EmileHenry.com site is strictly forbidden.
Emile Henry's obligations relating to the stages of sale on the online shop www.EmileHenry.com, are strictly a matter of exercising due care. Emile Henry cannot be held liable for any impediment to the proper functioning of the site resulting from the use of the Internet, such as a breach in service, outside intrusion or the presence of a computer virus, or for any event deemed to fall under force majeure, as recognised by law.
Emile Henry reserves the right to change the present general terms and conditions of sale at any time, the applicable terms and conditions being those in force at the time the order is placed.
The only data Emile Henry collects from clients is that essential to the successful completion of a sale and its delivery. The data collected is protected by secured access. Emile Henry undertakes not to transmit this data to a third party without prior authorisation from the client.
In accordance with the French Data Protection and Freedom of Information Law of 6 January 1978, you may at any time exercise your right of access, of rectification or withdrawal of these data by contacting us via our form.
Computerised records held by Emile Henry will be considered by the parties as proof of the communications, orders, payments and transactions that take place between the parties.
The present general terms and conditions of sale are subject to French Law. In case of dispute, and after trying to find an amicable solution, the French courts have sole jurisdiction.
