Sending and sharing data

EMILE HENRY may only submit your data to third parties in accordance with the legislation in force. We submit information on request to authorities, for example police and security authorities, as well as other authorities on grounds specified by law.

Information relating to our customers is an important part of our activity and it is our job not to trade it. We share such information only in the cases mentioned above and for the purposes described in this privacy policy, under EMILE HENRY monitoring; purposes that are either subject to this privacy policy or adhere to rules at least as protective as those described in this privacy policy.

In addition, we may submit your data to processors, in which case we will ensure that the confidentiality of the data is maintained, and we remain responsible for the processing of the data in such a case. Should we process your data outside of the EU region, we will protect your data by ensuring the processor processes the data properly.

Processing of identification and location data related to electronic communication

EMILE HENRY treats all data and messages created during communication with customers as confidential. Our staff are bound by an obligation of secrecy and a ban on the use of messages or other confidential information. When communication takes place over a network, it always leaves a trace. These network traces are called credentials if they can be connected to a person. Network traces are created, for example, when making phone calls, sending email and SMS messages, and browsing the Internet, and may contain information about callers, connection route or routing, the protocol used for data transfer, the event and the terminals used, or their location.

EMILE HENRY processes the identification and location information of the communication in accordance with applicable law for the purposes of, for example, the implementation and use of services, billing and technical development; or consent and marketing. The data may also be used for billing other service providers, as far as is necessary.

EMILE HENRY may also manage credentials in the event of misuse, data security breaches, and repairing computer crashes. In all of the above situations, we only process identification and location data to the extent necessary to accomplish a certain specific task.

Use of location data

An actual tracking method where another person can track another person's location requires the consent of the person to be located. The customer may not be located at all by choosing to decline geolocation services.

If we submit location information to location service providers, we ensure by appropriate means that consent is granted by the person to be tracked.

Persons authorised to process identification and location data

Only specific individuals at EMILE HENRY, whose work requires access to identification and location data, may process this data.

In practice, authorisation is only granted to persons performing tasks related to billing, maintenance or development of communication networks or services, prevention and investigation of abuse, customer service, and marketing. Persons with the right to handle the data may process it only to the extent required to perform individual tasks.

Duration of processing of identification and location data and data storage

We process identification and location data over the length of time required for purposes of billing, technical development, troubleshooting, marketing, misuse investigation or data security. However, data handling only takes place to the extent required by the actions and without unduly compromising a message's confidentiality and privacy.

We store the data required for invoicing for at least one year from the due date of the invoice, and for a period not exceeding three years from the due date of the invoice, unless it proves necessary to keep data for a longer period in order to collect a due invoice. In other cases, data is stored to the extent permitted and required by relevant legislation.

Monitoring website visits

We also collect data about website visits. This data includes the IP address and corresponding DNS name, the organisation that recorded the IP address, the name and address of the page visited, the time the page was loaded and the type of browser.

Please note that the IP address is an identification required for the operation of the Internet, used to direct messages transmitted over the Internet to the appropriate places. Typically, the IP address is not connected to the person who uses the computer, but it may be connected to the organisation that registered the IP address. The IP address connection can be established at the request of the authorities.

Cookies

As an EMILE HENRY customer, you may choose to view our websites anonymously. However, like most websites, we use cookie technology. When you view our website, the cookie sets a random number for the browser that does not show your identity. Cookies help EMILE HENRY determine what sections of its websites are the most popular, where visitors go and how long they stay there. The data is used to implement and develop services, and to target advertisements on websites.

You can prevent cookie storage by changing your browser settings. In some cases, prevention can slow down browsing or make it impossible to view pages or the website.

Data security

We safeguard the data for our services using methods proportionate both to the severity and sophistication of threats, and to the cost.

EMILE HENRY undertakes efforts to prevent data security breaches and eliminate disruptions that affect data security. Furthermore, we use all available means to ensure that the confidentiality of messages and the protection of privacy is not unduly compromised when performing the above actions.

We provide information about our services' data security actions and other data security matters through appropriate channels, such as our website or customer newsletters.

To prevent data security breaches and eliminate disruption to data security, we may, amongst other things, block receipt of email messages, remove viruses and other malware from messages, and take other similar measures that may prove necessary, within the permitted and required limits specified in the relevant legislation. We use physical, administrative, and technical protection measures to keep the messages and identification data transmitted over the communication network secret. These actions reduce the risk of data about you from being disclosed to third parties and prevent misuse or other unauthorised access. Some of our services also use standardised encryption methods.

Please note that as a user of EMILE HENRY's services, you should also use the most appropriate methods to ensure your own data security. We encourage you to store and use our services and your terminals with care; to control their use, for instance by using secure codes and unique passwords; to use sufficient anti-virus and firewall services and keep them up to date; and to keep your operating system up to date as well.

Customer communication and direct marketing

EMILE HENRY sends customer messages about its products and services to its customers according to the consent status on the customer account.

EMILE HENRY also sends direct marketing messages in electronic format. You have the right to prohibit EMILE HENRY from sending direct marketing messages. You may prohibit marketing by following the instructions included in the direct marketing message or through your customer account available on our website.
